Is your workers comp claim stuck?

Claims rarely announce they're stuck. They drift: a stale certificate here, an unanswered email there. By the time anyone calls it a problem, it's been a problem for months.

This check takes about two minutes. Answer for one claim at a time, honestly. If you don't know an answer, that tells you something too. On a well run claim, you'd know.

Nothing here is recorded and you won't be asked for an email. At the end you'll get a plain reading of where the claim sits and what your answers point to.

  1. 1.Has the claim been running longer than six months?

  2. 2.Is the current certificate of capacity less than a month old and specific about what the worker can do?

  3. 3.Is a return to work plan actually running in the workplace right now, not just on file?

  4. 4.Is the worker doing suitable duties at the moment?

  5. 5.Is the worker engaged: contactable, attending appointments, participating in the plan?

  6. 6.Are you getting responses from the insurer within a week or two, without having to chase?

  7. 7.Has there been a case conference or a scheduled review in the last eight weeks?

  8. 8.Can you name who owns the next step on this claim, and what that step is?

  9. 9.Could a psychological factor be sitting on top of the injury that no one has named?

  10. 10.Are costs still climbing, on the claim or anything you're paying outside it, like wages cover or providers you've engaged yourself?

What the check is looking for

In our work on complex and stuck claims, the same handful of patterns comes up again and again: capacity that was never made clear, a return to work plan that never landed in the workplace, a psychological factor no one has named, responsibility split between the insurer, the employer and the treating team, and a worker who has quietly disengaged. Each question above maps to one of those patterns. Two or more flags means the claim deserves attention now, not at renewal, when your options have narrowed.

This check is general education, not advice on any one file. If you'd like a specialist to look at a specific claim, that's exactly what we do.

Frequently asked questions

What counts as a stuck workers comp claim?

As a rule of thumb: a claim past six months with a stale return to work plan, no scheduled next step, or a worker who has disengaged. Any one of those is a warning sign; two or more means the claim is drifting.

Is this check recorded or shared?

No. Your answers stay in your browser and aren't stored or sent anywhere. You won't be asked for an email.
