In this policy, “IMA”, “we”, “us” and “our” means Injury Management Australia (ABN 49 679 596 153). We respect your privacy and are committed to protecting the personal information we collect and hold. We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

This policy explains what information we collect, how and why we use it, when we disclose it, and how you can access, correct or complain about the way we handle it.

The personal information we collect

Depending on how you interact with us, we may collect:

  • Enquiry details: your name, email address, phone number, organisation or company name, and the content of your message when you contact us or submit our enquiry form.
  • Website usage: pages viewed, device and browser type, approximate location derived from your IP address, and the site or link that referred you, collected through cookies and similar technologies.
  • Claim and service information: information we need to deliver our injury management and workers’ compensation claim services, described in the next section.

Sensitive and health information

Because we manage workers’ compensation claims and provide injury management services, we collect sensitive information, including health and medical information about injured workers. This may include details of an injury or condition, medical certificates and reports, treatment and rehabilitation information, and capacity for work.

We only collect sensitive information where you have consented, or where the collection is required or authorised by law, and only to the extent needed to manage a claim or provide our services. We take extra care with sensitive information and only use and disclose it for the purpose for which it was collected, a directly related purpose you would reasonably expect, or as permitted by law.

How and why we use your information

We use personal information to:

  • respond to your enquiries and provide the information you request;
  • deliver, manage and administer our injury management and claim management services;
  • maintain and improve our services and this website;
  • analyse how visitors use our website so we can improve it; and
  • meet our legal, regulatory and record-keeping obligations, including under relevant workers’ compensation schemes.

Cookies and analytics

We use cookies and similar technologies to help the website work and to understand how it is used. We use Google Analytics to collect anonymous statistics about visits, such as pages viewed and general location. You can opt out of Google Analytics by installing Google’s browser opt-out add-on, and you can control or delete cookies through your browser settings.

When we disclose your information

We do not sell your personal information. We may disclose it to:

  • third-party providers who help us operate, including our website hosting provider, our enquiry form and email delivery provider, and our analytics provider;
  • in the course of managing a claim, parties involved in that claim such as insurers, employers, treating practitioners, rehabilitation providers and scheme regulators, as needed to manage the claim and as permitted by law; and
  • government, regulatory or law enforcement bodies where we are required or authorised by law to do so.

Some of our providers, including Google Analytics, may store or process data overseas, including in the United States. Where this happens we take reasonable steps to ensure your information is handled consistently with the APPs.

How we store and protect your information

We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. Our website is served over an encrypted (HTTPS) connection. No method of transmission or storage is completely secure, but we work to protect your information and to keep our safeguards up to date.

How long we keep your information

We keep personal information only for as long as we need it for the purposes described in this policy, or for as long as we are required to keep it by law. Claim and health records may be subject to minimum retention periods under workers’ compensation and other legislation. When information is no longer needed, we take reasonable steps to destroy or de-identify it.

Accessing and correcting your information

You may ask us for access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date or incomplete. There is generally no charge to make a request. To protect your privacy we may need to verify your identity before we act on a request. Contact us using the details below.
